LOCAL ENFORCEMENT OF SPEED LIMIT ON STATE HIGHWAY
ARTICLE 1. AUTHORITY.
This ordinance is adopted by the Town of Sheffield under authority granted by 24 V.S.A. Chapter 59, 23 V.S.A. § 1007 and 13 V.S.A. § 7251.
ARTICLE 2. PURPOSE.
The purpose of this ordinance is to promote public safety.
ARTICLE 3. SEVERABILITY.
If any portion of this ordinance is held unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected.
ARTICLE 4. SPEED LIMITS.
The maximum speed limit permitted for any vehicular traffic on Vermont Route 122 within the Town of Sheffield shall be the same as those limits established and posted by the State of Vermont, to wit:
a. Proceeding north from the Sheffield / Wheelock town line approximately 1.1 miles, the speed limit shall be fifty (50) miles per hour;
b. Proceeding north from the ending point designated in subsection (a) approximately 0.2 mile, the speed limit shall be forty (40) miles per hour;
c. Proceeding north from the ending point designated in subsection (b) approximately 0.4 mile through Sheffield village, the speed limit shall be thirty-five (35) miles per hour with the exception of a designated school zone, during school commuting hours of 7:30 am to 8:30 am and 2:30 pm to 3:30 pm when school is in session, the speed limit shall be 30 miles per hour during such times in this designated zone;
d. Proceeding north from the ending point designated in subsection (c) approximately 0.2 mile, the speed limit shall be forty (40) miles per hour;
e. Proceeding north from the ending point designated in subsection (d) approximately 5.6 miles to the Sheffield / Glover town line, the speed limit shall be 50 miles per hour.
ARTICLE 5. PENALTIES.
a. This is a civil ordinance which shall be enforced in accordance with the provisions in 24 V.S.A. §§ 1974a and 1977 et seq.
b. The penalty for violation of any of the above speed limits shall be that set by the Schedule of Fines established by the State of Vermont.
ARTICLE 6. ENFORCEMENT OFFICIALS.
Issuing officials shall include any officer from the Vermont State Police, Caledonia County Sheriff’s Department or any certified Sheffield constable.
ARTICLE 7. EFFECTIVE DATE.
This ordinance shall become effective 60 days after its adoption by the Sheffield Selectboard. If a petition is filed under 24 V.S.A. § 1973, the taking effect date of this ordinance shall be governed by that statute.
